Disability Benefits Litigation
When an insurer denies or cuts off the disability or accident benefits you rely on, we challenge the decision and fight for the income you are owed.
An injury that keeps you from working affects every part of your life. Short-term disability, long-term disability and statutory accident benefits are meant to provide a financial safety net — but insurers frequently deny applications, demand repeated assessments, or terminate benefits after a period of time.
We review your policy, your medical evidence and the insurer’s reasons, and then take the steps needed to have your benefits reinstated — through negotiation, an appeal, the Licence Appeal Tribunal (for motor vehicle accident benefits) or a lawsuit in the Ontario courts.
How we can help
Denied long-term disability claims
Group and private LTD policies, including “own occupation” to “any occupation” transitions.
Terminated benefits
Benefits cut off after an insurer examination or surveillance.
Income replacement benefits
Accident benefits for people injured in car, bike and pedestrian accidents.
Medical & rehabilitation benefits
Treatment plans and attendant care that the insurer has refused to fund.
Frequently asked questions
My long-term disability claim was denied. Is it too late to do anything?
Not necessarily. In Ontario, the general limitation period to start a lawsuit is two years, but the date it begins to run depends on your policy and the insurer’s decision letters. Contact us as soon as possible so we can review the deadlines that apply to you.
Should I file the insurer’s internal appeal first?
Internal appeals are optional in most cases and do not always pause the limitation period. We can advise whether an appeal helps your case or simply delays it.
